Rules & Regulations

Adopted with revisions – Annual Membership Meeting, October 16, 2015

These rules and regulations apply to all condominium unit owners, occupants, their guests and visitors and rental agents. They should be made available and displayed in each unit. They are designed to promote the safety, comfort, convenience, and enjoyment of residents and the preservation of all property.

OWNER RESPONSIBILITY

Each owner shall regulate and be responsible for the occupancy and use of his/her villa.

LOUD NOISE.

No owner/occupant shall permit any musical instrument, music player, televisions, or radio equipment to disturb and annoy other residents/guests of the building. Owner shall use all reasonable effort to minimize noise emanating from his villa.

CLEANING, REFUSE AND BALCONIES.

Mops, cloths, brooms, rugs and vacuum cleaning bags shall not be dusted, shaken or beaten from windows, balconies, terraces, in hallways or on the exterior part of the condominium property. Refuse and garbage (including bottles and cans) shall be tightly wrapped and fastened in plastic or paper bags before depositing in disposal installations provided for such purposes in the service areas. No garments, towels, rugs, or similar objects shall be hung from windows, balconies, or from any exterior facades of the property.

ANTENNAS, FLOWER BOXES, ETC.

No owner shall install wiring for electrical or telephone connections, television or radio antennae, machines or air conditioning units or similar objects outside of his dwelling or which protrude through the walls or roof of his/her unit, except as authorized by the board of directors. No flower pots, boxes or other appurtenances shall be kept or suspended on windows, balcony rails, or ledges.

EXTERIOR APPEARANCE.

No signs, advertisements, or notices shall be exhibited, inscribed, painted, or affixed on any part of the outside or inside of the premises of the building by any owner. No awnings, enclosures, shutters, shielding, or other projections shall be attached to the outside walls of the building or balconies or terraces. The exterior appearance of the balconies and terraces may not be altered.

INGRESS AND EGRESS

The sidewalks, entrances, passages, stairways, roads, lobby vestibule, elevator, corridors, and other areas of a similar nature shall not be used for any purpose other than ingress and egress to and from the premises. No owner will place in these areas any furniture, packages, or obstruction of any kind.

PETS.

No owner shall maintain any pets that cause distress to other owners, their tenants, and guests through barking, howling, biting, scratching, or damaging property. All dogs shall be on a leash, and the dog owner shall collect and dispose of all dog waste.

NO GLASS AT POOL.

No glass materials shall be used in the immediate area surrounding the swimming pool.

SKATEBOARDS PROHIBITED

Skateboard use is prohibited on the Beach Walker Association property.

GRILLING

No open flame cooking or heating is allowed on balconies, covered terraces, parking areas, and other common property areas except in the area designated for outdoor grilling.

WINDOW AND DOOR REPLACEMENT SPECIFICATIONS.

All window and sliding glass door replacements must be completed in accordance with the approved replacement specifications and details described in the guideline dated April, 2014.

CONSTRUCTION WORK HOURS.

Work on all construction projects shall be done between the hours of 9 AM and 5 PM Monday through Saturday.

HVAC CONDENSATE LINES AND SHUT-OFFS.

All air conditioning condensate lines shall be regularly cleaned and treated to avoid backups. On and after December 31, 2015 all air conditioning condensate lines shall be equipped with an automatic shutoff to prevent the operation of the HVAC equipment if the condensate line is blocked.

WATER HEATER DRAIN PAN.

On and after December 31, 2015 all water heaters shall be situated in a drain pan the sides of which have a height of 1.5 inches, which pan shall be plumbed to a drain line in compliance with the Florida Building Code – Plumbing.

WATER HEATER AGE LIMIT.

On and after December 31, 2015 no metal or glass lined water heater more than ten years old shall be used in any unit. This requirement does not apply to molded polybutylene water heaters which carry a manufacturer’s lifetime warranty against leakage.

WASHER SUPPLY LINES.

On and after December 31, 2015 all washing machine supply lines shall be made of braided stainless steel.

ICE MAKER SUPPLY.

On and after December 31, 2015 all ice maker supply lines shall be made of braided stainless steel.

CONTRACTOR MUST BE LICENSED

All electrical, plumbing, HVAC, or window or door replacement work shall be performed by a contractor licensed in Florida and insured.

ADVANCE NOTICE OF WORK
  • Before any work is done which requires shutting off the water to any other condominium unit
  • involves any remodeling or interior changes to a unitinvolves changing the floor covering of any unit
  • involves replacement of a window or sliding door, notice at least seven days in advance of the commencement of the work must be given to the community association manager.

 

OWNERS RESPONSIBLE FOR CONTRACTOR

Owners are responsible for the actions of their contractors, and should provide the contractors with a copy of these rules prior to the initiation of work.

CONTRACTOR VIOLATIONS OF RULES.

Any contractor who repeatedly violates these rules may be barred from performing work on the Beach Walker premises by the community association manager.

FLOOR TILE

Sound-deadening materials under tile floors shall be used so that the floor/ceiling assemblies between dwelling units have an impact installation class (IIC) rating of not less than 65 when tested in accordance with ASTM E 492. This applies to the installation or replacement of floor tile or the substitution of tile for carpet.

TRAILERS.

No trailers shall be left overnight on the Beach Walker premises. Any trailer left overnight is subject to being towed at the owner’s expense.

KEY TO BE KEPT ON FILE.

Owners shall furnish keys or entry codes to the condominium unit to the community association manager. In the event that emergency access to the unit by the association is required and no key or code is available, entry will be achieved by a locksmith or other means. All expenses incurred in making such entry will be the responsibility of the owner.

CONSTRUCTION AND REMODELING, NOTICE, BOND

Before any owner undertakes any major renovation of a unit, notice and a financial deposit shall be provided to the community association manager as provided in this rule. A major renovation consists of work with an expected cost of more than $5,000, or which includes alterations to the interior wiring, plumbing or floor covering of the unit. The notice to the community association manager shall include a detailed list of the work to be performed, the estimated dates of the beginning and completion of the work, and the names of the contractor and subcontractors who will perform the work. This notice shall be provided more than 30 days prior to the beginning of work. At the time of providing notice, the owner shall deposit with the community association manager a deposit of $1,000 to cover any damage to the common elements of the condominium association or any expense incurred by the association caused by the construction or remodeling, including the cost of periodic inspections by the association’s engineering consultants. At the conclusion of the work, any portion of the deposit which has not been exhausted shall be returned to the owner. Any damages or expenses to the condominium association in excess of the deposit will be the responsibility of the owner. If an owner undertakes a renovation project without providing the notice and deposit, in violation of this rule, the condominium association may order the work to be stopped.
